Who We Are

Since 2003, Baker & Partners has been at the forefront of some of the most complex and high value commercial and trust litigation in Jersey.  We believe that no legal problem is unsolvable.  The firm builds on the wealth of experience of its founding Partner, Stephen Baker and the combined decades of expertise of its senior lawyers.

We operate out of offices based in Jersey, London, Cayman and BVI and maintain straightforward, objective and independent advice. We remain conflict free by not operating an associated trust company or financial services business.

We have recently established Baker Regulatory Services Limited, a unique offering which provides specialist regulatory services.

Our History

Baker & Partners is unique among Jersey firms in being led by a partnership of very experienced courtroom advocates who have between them conducted a very large number of trials both in England and Jersey. This has earned the firm a reputation for the kind of forensic and incisive analysis of a dispute that is the hallmark of the English bar.

Our Senior Partner Stephen Baker is the only Jersey litigation lawyer who is actively involved in the International Bar Association. He was Chairman of the Asset Recovery Subcommittee for 2018/19. He is a much sought-after speaker at conferences internationally.

Working with the partners is a substantial and experienced team of high-quality lawyers and assistants, selected for their ability to bring home outstanding results.

Advocate James Sheedy’s book ‘Litigating Trust Disputes in Jersey: Law, Procedure and Remedies’, published by Bloomsbury, is the only legal practitioner text of its kind in Jersey and continues to attract praise locally and overseas.

 

What we do

For over 15 years the firm has acted in some of the most substantial Jersey litigation including contentious trust and commercial matters, fraud, asset recovery and regulatory cases. Our work is often highly complex and usually has an international component. Baker & Partners acts for blue chip companies, trustees, beneficiaries, high net worth individuals and governments.

The firm has been responsible for recovering many hundreds of millions of pounds on behalf of corporations, individuals and governments.

Among the cases in which the firm has acted are the well-known Crociani v Crociani, Trilogy Management Limited v YT, Dalemont v Senatorov and Brazil v Durant. The firm continues to act for the Plaintiff CMC Holdings against Royal Bank of Canada in Jersey’s leading ongoing civil asset recovery litigation.

The firm also acted for: Grant Thornton as liquidators of BVI companies found liable for substantial corrupt activities; judgment creditors against a subsidiary of Y, the oligarch X’s company (confidential); X in which we will act for the creditors of one of the UK’s largest arbitration awards; and successfully prosecuting the former managing director of Lumiere Wealth Limited, a firm of independent financial advisers for a number of mis-selling offences in connection with investments in a high risk, unregulated Guernsey fund investing in factoring of receivables in Brazil.

In order to service the needs of these types of cases, Baker & Partners has a long established and successful track record of assembling multi-jurisdictional teams of lawyers, insolvency practitioners and other professionals to achieve the very best results.

The firm has been a pioneer in the use of international treaties, agreements and statutory powers to achieve results in litigation where none had been thought possible.
