James is an English barrister and Jersey Advocate, who joined Baker & Partners in January 2014. James has a busy Jersey practice with a particular focus on contentious and non-contentious trust work.
James advises, undertakes drafting work, and acts for beneficiaries, trustees and other power-holders in relation to:
Breach of trust claims, asset tracing/recovery and claims for secondary liability against accessories.
Issues concerning trust administration, the appointment and removal of trustees and the exercise of powers.
Applications to court for directions, the variation and rectification of trusts and the disclosure of information to beneficiaries and third parties.
Jurisdiction disputes and the enforcement of foreign judgments against trustees and beneficiaries.
Issues concerning trustees’ rights of indemnity, fees and legal cost.
James also advises in relation to a broad range of contentious commercial and company law disputes.
James is ranked as a Notable Practitioner in the Chambers and Partners 2019 Offshore Dispute Resolution Guide. They said ‘James focuses his practice on handling trust disputes and has been particularly active recently on behalf of trustees. His clients emphasise his “great technical knowledge and commercial awareness”.
James is a member of the Association of Contentious Trust & Estate Practitioners (ACTAPS), Contentious Trust Association (Contra) and the Chancery Bar Association. James is also a member of the Trust Law Working Committee of Jersey Finance that considers amendments to the Trusts (Jersey) Law 1984.
James is the author of ‘Litigating Trust Disputes in Jersey: Law, Procedure & Remedies‘. This substantial book is Jersey’s first practitioner text dedicated exclusively to trust litigation in Jersey’s courts.
James also authored ‘Bust Trusts – Navigating Indemnities, Insolvency & Liability’, June 2019, Jersey and Guernsey Law Review and ‘Count Your Blessings’ , July 2019, Trusts & Estates Law & Tax Journal.
