Daian Sumner

Daian is a Senior Associate at Baker & Partners. She holds a BVI practising certificate.

Daian specialises in commercial litigation work, with a focus on insolvency and debt restructuring, asset tracing and recovery, corporate and shareholder disputes and contentious trusts.

Daian frequently works on matters with onshore and offshore elements with insolvency practitioners, experts, and senior counsel. She has extensive experience of all stages of litigation including advising clients before proceedings are issued, drafting statements and applications, and preparing cases for trial.

Daian has extensive courtroom experience appearing in England and Wales and in the Commercial Court in the BVI making applications at all stages of litigation.

Daian has been involved in significant and complex matters including:

1. Advising and representing Pacific Andes Enterprises (BVI) Limited and others in a complex multi-jurisdictional insolvency matter.
2. Resolving the BVI litigation costs in Nilon Limited v Royal Westminster Investments.
3. Advising on the enforcement of a costs order against the ultimate beneficial owner of a BVI company.
4. Litigation against a nation state in respect of their seizure of an asset under an interim proprietary freezing order.

Before joining Baker & Partners in June 2021 Daian worked in the Dispute Resolution department of a large offshore law firm.   She has worked for boutique offshore law firms in the BVI.  Prior to relocating to the BVI in 2016, Daian practised as a commercial / chancery barrister focusing on commercial litigation, insolvency and chancery work from leading sets of Chambers in the North of England.

Before commencing pupillage in Chambers, Daian taught law at undergraduate and postgraduate level.  She has held lecturer and senior lecturer posts at Manchester Metropolitan University, was a visiting lecturer at the University of Hong Kong for several years and has taught on the Bar Vocational Course.  Daian was also appointed as one of the external examiners for the Chancery module of the Bar Vocational Course by the Bar Standards Board.
