The firm is regularly instructed by regulators, institutions and private individuals to advise, act and investigate in a wide range of  highly complex and challenging situations. Usually these matters are resolved without litigation, but where necessary the firm’s expertise in litigation comes to the fore.

Regulatory Compliance

Our lawyers’ experience and trusted status acting for both the regulator and the regulated enables us to provide informed and balanced advice and representation.

  • The firm has acted for numerous firms and individuals against whom regulatory sanctions were proposed.
  • We are on the panel of lawyers able to act for the Jersey Financial Services Commission (JFSC).
  • We have advised for both the JFSC and regulated businesses on various aspects of compliance with Jersey’s financial regulatory laws and codes, including those relating to anti-money-laundering (AML) and sanctions.
  • We advise the Attorney General in relation to prosecutions for breaches of the money laundering regulations.  We were instructed to prosecute the Abu Dhabi Commercial Bank for breaches involving withdrawals of cash worth almost £1m from its Jersey branch accounts, leading to a fine of £475,000, the largest such fine.

Funds

The firm has acted in litigation arising from collapsed funds in Jersey. It acted in the R2R and Belgravia cases. It has advised businesses in respect of regulatory investigations or potential regulatory investigations into other collapsed funds.

Investigations

Our Partners have decades of experience in conducting investigations into regulated businesses’ AML compliance and/or corporate governance, both for the JFSC and for the financial services businesses themselves.

  • The firm has also conducted an internal investigation for a financial business into suspected insider dealing.
  • Our combined litigation experience equip us well to identify the key issues under investigation, focus inquiries and provide cogent conclusions and recommendations.
